The Newberry County Sheriff’s Office reported the following:

— Elijah Brook Nelson, 18, of 921 S.C. 66, Whitmire; Shawn Vincent Duncan, 21, of 2026 Piedmont St., Newberry; and Teddy Levonia Spearman Jr., 21, of 2746 College Wood Drive, Newberry, were charged with separate offenses on Sept. 1. Nelson was charged with open container, simple possession of marijuana and possession of drug paraphernalia. Duncan was charged with unlawful carry of a pistol and giving false information. Spearman was charged with simple possession of marijuana. Nelson was driving a vehicle that was stopped at a checkpoint and Duncan and Spearman were passengers. Officers smelled marijuana and saw an open can of beer in the back seat. As Nelson pulled over to the side of the road, officers saw Duncan pull a pistol from his pants. Officers pulled their weapons and ordered all three out of the car. When asked what he pulled from his pants, Duncan said he had a handgun and put it in the glove box. During a search of the car officers found a scale, wooden grinder with marijuana still inside, a pack of White Owl Cigarillos, the pistol and a Smith & Wesson revolver. The revolver came back clear. Nelson admitted that the open container, marijuana and paraphernalia belonged to him. When asked his name, Duncan gave a false name then admitted his name was Shawn Duncan, saying he lied because he was nervous. Marijuana was found in Spearman’s socks.

— Brandon Paul Hendrix, 30, of 926 Lindsay Circle, Newberry, was charged with simple possession of marijuana and assault and battery third degree on Sept. 5 after officers were called to his home and told by the victim that Hendrix was only allowed to live in the basement portion of the home, not the main residence, due to past incidents were Hendrix caused damages. On Sept. 5, Hendrix became belligerent after consuming alcohol and attempted to assault the victim. He grabbed a glass flower pot and attempted to assault the victim with it. Hendrix had to be restrained by the victim and his two sons. Marijuana was found in Hendrix room while officers were speaking with the victim.

— Gabriel Ian Graham, 37, of 126 Green Acres Lane, Silverstreet, was charged with open container in a vehicle and public intoxication on Sept. 6. Officers received a call that a car parked at complainant’s property was was not supposed to be there. When officers arrived they found Graham asleep in the front seat. After waking him, Graham said he was in a parking lot on S.C. 121. Officers could smell alcohol coming from Graham, and observed an open bottle of vodka. After searching the car, officers found an empty can of beer.

— Donna Lynn Helmer, 56, of 577 Twin Pounds Road, Newberry, was charged with drunkenness and domestic disturbance on Sept. 10. Officers received a call of possible domestic disturbance at Twin Pounds Road and found Helmer walking in the roadway. She told officers she had a verbal argument with the complainant. Officers could smell alcohol on her and when they asked her if she had been drinking, Helmer said yes.

— Christian Martin Mitchell, 22, of 106 Huffield Road, Chapin, was charged with trespassing after notice and public intoxication on Sept. 15. During a Newberry High School football game, officers received a complaint about Mitchell arguing with another fan and yelling profanities. While an injured player was down on the field, Mitchell was yelling profanities about the player. The complainant attempted to talk to Mitchell to get him to calm down and move to another seat, but Mitchell said he did not have to move and could sit or stand where he wished and continued to yell profanities. When officers approached Mitchell, they could smell alcohol and noticed his speech was slurred. Once at the jail, it was discovered that Mitchell is under trespass notice for Mid-Carolina High School and all athletic fields.
